LACEY (http://www.nj.com/lacey) — The nation's oldest nuclear power plant will close in 2019 — 10 years earlier than planned — but will not have to build costly cooling towers, according to two people with direct knowledge of the situation.
The people, who spoke to The Associated Press on today on condition of anonymity because they weren't authorized to discuss the plans ahead of an announcement expected Thursday, said the Oyster Creek Nuclear Generating Station in the Forked River section of Lacey Township will close a decade earlier than called for under its current license.
In return, the aging plant will not be required to build one or more cooling towers to replace its current technology, which draws 1.4 billion gallons of water a day from Barnegat Bay, killing billions of aquatic creatures each year.

This was part of a recent newsletter. While the Baykeeper is an admirable steward of the bay areas in some respects, I wonder if the lawsuit mentioned didn't somehow push this Oyster Creek closing to the forefront?

Agreement Paves Way for New Regulations to Protect Aquatic Species by 2012

On November 22, 2010 NY/NJ Baykeeper and other environmental organizations signed a settlement agreement with the Environmental Protection Agency (EPA) that resolves two lawsuits brought against the EPA in 1993 and 2006 addressing the agency's failure to issue regulations implementing Section 316(b) of the Clean Water Act. This section of the Act requires power plant operators and other large industrial water users to employ the "best technology available" for minimizing the adverse environmental impact of their operations on aquatic ecosystems. Currently, cooling water intakes at hundreds of facilities across the country take in huge volumes of water from vital ecosystems like the Hudson River, resulting in the destruction of huge numbers of fish and other aquatic species at all life stages from being "impinged" against intake screens or "entrained" through the facility cooling system. Decades of such impacts have contributed to declining fish populations and destabilized marine and freshwater ecosystems.
In the settlement, the EPA agreed to draft new regulations for existing facilities by March 14, 2011, and to take final action regarding the new regulations by July 27, 2012.

A public meeting will be held on the safe operation and closure of Oyster Creek Generating Station on Nov. 5 in Toms River.
The meeting, which was announced by the New Jersey Department of Environmental Protection, will run from 6 to 7:30 p.m. at the Ocean County Administration Building.

Members of the Oyster Creek Safety Advisory Panel will be available to discuss plant-related matters. The panel was created (http://lacey.patch.com/articles/dep-develops-oyster-creek-safety-advisory-panel) to assist the DEP with the evaluation of the safe operation and cessation of operations at Oyster Creek, a news release said.

The panel consists of DEP Commissioner Bob Martin, Office of Homeland Security and Preparedness Director Edward Dickson and independent consultant Adam Cohen.

The closure of Oyster Creek was announced in December 2010. The public will be included in the decommissioning process as several meetings are to be held by the Nuclear Regulatory Commission in the vicinity of the nuclear plant. Paul Baldauf, Director of the DEP, noted that the Nov. 5 meeting is not a part of that process.

"The purpose of this meeting is to provide the public an opportunity to speak to the Panel and communicate any concerns regarding the operation of Oyster Creek and the cessation of operations in 2019," he said.

The public meeting will be held similarly to a “town” meeting, according to Tammy Morin, Nuclear Engineer of the Bureau of Nuclear Engineering at the DEP. The public will have the opportunity to provide comments for the panel to consider, she said. Questions may also be asked.

At this time, there is no confirmation that a formal presentation will be held at the meeting.
The Ocean County Administration Building is located at 101 Hooper Avenue in Toms River. The meeting will be held in room 119.
