NJOA meets with legislator sponsoring bill to allow sale of wild striped bass

March 2014

NJOA council members Sergio Radossi (Hudson River Fishermen's Assoc.) and Tom Fote (Jersey Coast Angler's Assoc.) met with Assemblywoman Caride to discuss opposition of the bill she sponsored that would allow the sale of wild striped bass caught outside of New Jersey.

NJOA is appreciative of the opportunity to voice our concerns with the bill's sponsor. A special thanks to Brad Burns, President, Stripers Forever, for his input.

- Striped bass are game fish in NJ because the state recognizes their superior socio-economic worth as one species to set aside for the benefit of the recreational fishing public. Commercial fishing seriously depletes fish stocks, and encouraging commerce in wild striped bass (even if they weren't landed in NJ) undermines NJ's values when it comes to striped bass.

- Allowing traffic in wild striped bass creates a cover for unscrupulous fishermen to sell fish on the black market to fish dealers or restaurants who will pay cash for the fish. This is seen in states that allow commercial striper fishing.

- The population of striped bass is in serious decline throughout its range. Severe cuts in commercial and recreational harvest are expected to be mandated by the ASMFC as soon as 2015. This is no time to aid in the expansion of commercial fishing for striped bass.

- Striped Bass are known to carry elevated levels of mercury and in many cases PCBs. The New Jersey Department of Health recommends very limited or no consumption of these fish for most of the population. This warning is similar to those in almost every coastal state in the striped bass range.

- Hybrid striped bass (a cross between a striped bass and a white bass) are currently sold in NJ and served in restaurants and markets. These fish are raised in land based ponds and carry no risk of toxicity.

- The volume of possible wild striped bass to be processed or sold in NJ is very minimal. Striped bass are the top predator among inshore species of fish and their numbers are very limited by nature. The economic opportunities versus risks are a poor trade-off.

Allows sale of wild striped bass caught outside of NJ.

CURRENT VERSION OF TEXT

As introduced.

An Act concerning the sale of certain striped bass and amending P.L.1991, c.43.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:

1. Section 2 of P.L.1991, c.43 (C.23:5-45.3) is amended to read as follows:

2. No person shall sell, barter, possess for sale or barter, or offer for sale or barter any striped bass [, whether] caught within the jurisdictional limits of this State [or otherwise, provided that this section shall not prohibit the shipment or transportation of striped bass from another state or country into the State which is destined for shipment or transportation out of the State or prohibit the sale of commercially raised hybrid striped bass]. However, a person may ship, transport, sell, barter, possess for sale or barter, or offer for sale or barter in the State:

a. any commercially raised hybrid striped bass; or

b. any striped bass caught outside of the jurisdictional limits of the State, provided that the person possesses sufficient documentation, as determined by the Commissioner of Environmental Protection, to prove that the striped bass was legally caught within the jurisdictional limits of another state or country that allows fishing for striped bass.

2. This act shall take effect immediately.

STATEMENT
This bill would allow wild striped bass caught outside of the State to be sold in New Jersey.
Current law, section 2 of P.L.1991, c.43 (C.23:5-45.3), provides that no person shall sell, barter, possess for sale or barter, or offer for sale or barter any striped bass, whether caught within the jurisdictional limits of this State or otherwise. This bill removes this prohibition for striped bass legally caught outside the jurisdictional limits of New Jersey.

The bill would require the person shipping, transporting, selling, bartering, possessing for sale or barter, or offering for sale or barter the striped bass to possess sufficient documentation, as determined by the Commissioner of Environmental Protection, to prove that the striped bass was legally caught within the jurisdictional limits of another state or country that allows fishing for striped bass.

She prob wants striped bass for sale because she wants to eat them all. She's a big girl I bet she could eat a whole striper, 5 lobsters, and a dozen crabs before her first burp.

Well if you don't like it send her an e-mail! I did and asked her why we need to sell wild striped bass in nj when there will be so much illegal selling going on if it does happen. Waiting for her response. Her e-mail

Many LI chinese fish markets have wild striped bass for sale. If you let them sell in Jersey you will have the same thing happen there.

x2 in mass it's a nightmare with the commercial sales. Almost any Chinese restaurant will buy your stripers. When they see the cooler in your cooler rack they have asked me more than once to see my fish and if I will sell them. Bad news to allow this bill.

There are a lot of restaurants in bergen and passaic that want to serve striped bass. They don't care that there was a moratorium for them in the 80s or that although they are recovered they are in danger again. She probably does not know or care about any of this. You can't blame the commercials for this one those counties are too far inland. This amazes me how one woman could be so stupid so as not to research before she supports a bill.
